Internal Use and Redistribution of Model Results

An internal dashboard, a client report and a downloadable dataset are different distribution workflows. A licence review becomes more useful when those workflows replace vague labels such as business use.

Map what each recipient receives, through which channel, for which purpose and with what onward access. Request explicit treatment of internal users, advisers, clients, public publication and machine-readable redistribution. Review model and underlying data permissions separately, and obtain jurisdiction-specific review of any investment communication obligations.

Draw the recipient boundary first

Start with actual recipients, not a shared email domain. Employees of the contracting entity, another group company, an external consultant and an end client may occupy different positions under an agreement. Describe why each recipient needs access and whether they receive raw values, selected charts or a narrative interpretation. This creates a concrete basis for review without assuming that every communication within a corporate group is internal use.

WIPO's technology-transfer overview describes licence scope as agreement-specific. Apply that distinction by separating the proposed commercial scope from the technology used to deliver it. A password-protected page can still serve external recipients, while an internal file can be exported onward. Security controls help implement an agreed boundary, but their presence alone does not establish that the boundary matches the permissions the parties have actually negotiated.

Describe the content that leaves the team

A complete output feed is different from a single attributed chart, and a chart containing identifiable instrument scores is different from a general narrative summary. Inventory the underlying values visible in each format, including hover details, downloadable attachments and spreadsheet tabs. Do not classify an export solely by its cover page. A report that looks aggregated can still contain a machine-readable table of individual results in an appendix.

Ask whether the proposed permission covers screenshots, extracts, translated documents, cached pages and recipient downloads. These are questions for the specific agreement, not categories with universal answers. Keep the intended audience and purpose attached to each example. Permission requested for a private client meeting should not silently expand into permission for a public newsletter, a resale dataset or a third party's model-training pipeline later in the year.

Separate publication permission from communication review

Even where the relevant licence permits sharing, the resulting investment communication may need a separate compliance review. The SEC's investment-adviser marketing guide describes conditions for advertisements containing hypothetical performance within that rule's scope. It does not make every model chart an advertisement, and it does not grant rights to a provider's material. The buyer's status, audience, content and jurisdiction need to be considered together by qualified reviewers.

Give those reviewers the actual draft rather than a general assurance that it contains no recommendations. Include captions, methodology notes, selected periods and the surrounding sales narrative. A permitted data extract can still be presented misleadingly, while a balanced explanation can still exceed its contractual distribution scope. Maintain separate signoffs for permission, factual accuracy and applicable communication requirements so approval in one area cannot be mistaken for approval in all three.

Work through a hypothetical reporting request

A hypothetical buyer proposes twelve monthly reports for thirty client organizations, with one report delivered to each organization every month. That is 12 x 30 = 360 planned report deliveries, not necessarily 360 licensed users. Each report would contain two model charts, producing 720 chart appearances across those deliveries. These counts describe a proposed workflow; they are not a vendor's charging basis or evidence that the reports are already authorized.

Procurement sends a sample report and asks whether this specific audience, frequency and chart content can be covered. It excludes raw downloads and public web publication from the initial request. If a client later asks for the full historical table, that is a new review item rather than a minor formatting change. The team also records whether client archives and recipient forwarding need explicit treatment before any real delivery begins.

Make the approved scope operational

Translate the reviewed scope into a distribution register containing report type, recipient class, permitted fields, channel and approval owner. Configure export permissions to match that register. Keep sample approved layouts alongside the decision so an analyst can recognize when a new request changes the substance. The register is an operational aid, not an amendment to the agreement or a mechanism for granting rights that remain unresolved.

Check less visible routes such as support tickets, shared notebooks and meeting recordings. An engineer investigating a display problem may attach a complete output file to an external service, even when routine client reports contain only charts. Decide in advance how restricted examples can be sanitized or shared through an approved support channel. Test these controls with synthetic material rather than sending real licensed data merely to see whether an export succeeds.

Review changes before they become habits

Set review triggers around new recipient classes, public publication, embedded feeds and onward reuse. Growth in the number of reports may matter commercially, while a change from static images to interactive downloads may change the rights question more fundamentally. Record both dimensions. A renewal discussion should compare the actual distribution inventory with the agreed scope, rather than rely on the scope remembered from an early sales demonstration.

Retain the relevant agreement version, approved samples and review decisions according to the applicable retention framework. Where permissions are unclear, hold the disputed distribution path while pursuing clarification; do not treat silence as a contractual interpretation. This guide offers a procurement method, not legal advice about enforceability. The final assessment belongs to the actual documents, relevant law and qualified reviewers familiar with the buyer's activities and intended recipients.

  • Count deliveries and recipients without inventing a pricing metric.
  • Recheck permissions when a report becomes a downloadable feed.

Evaluation checkpoints

  • Internal use depends on the agreed scope, not simply the delivery channel.
  • Publication permission and investment-communication review are distinct.
  • Use actual sample reports to resolve distribution questions.
